Terms of Service
1. Definitions
"Siterka" means the website at siterka.com and any related mobile applications, operated by the Siterka team (referred to as "we", "us", or "our"). "User" or "you" means any person who creates an account, browses listings, posts a profile, sends a message, or otherwise interacts with the platform. "Caregiver" means a sitter, nanny, tutor, or pet-sitter who lists services on the platform. "Careseeker" or "parent" means a person looking to engage a caregiver.
"Content" means any text, photograph, message, rating, blog post, profile, or other material a User submits to the platform. "Listing" means a published profile or job post visible to the public. "Subscription" means any paid plan that unlocks features beyond the free tier. The Siterka platform is a directory and communication tool — we do not employ caregivers, screen them, supervise their work, or guarantee their performance.
2. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract under the laws of your country to use Siterka. The platform is intended for adults arranging childcare or related caregiving services. You may not create an account on behalf of another person without their explicit authorization, and you may not impersonate any person or entity.
If we discover that an account belongs to a minor, or that the account holder has provided materially false identifying information, we may suspend or delete the account at our discretion. Caregivers offering care for minors must comply with all applicable laws of the Republic of Serbia, including those governing work permits, taxation, and child welfare.
3. Account creation and verification
To list a profile, post a job, send a message, or save bookmarks you must register an account using a valid email address. You are responsible for keeping your password confidential and for all activity that occurs under your account. Notify us immediately at the contact address below if you suspect unauthorized access.
We may verify your account by sending a confirmation link to the email address you provide. New accounts may be held in a pending state until an administrator approves them; this is a basic anti-fraud measure and approval is usually granted within one business day. We reserve the right to refuse, suspend, or delete any account that contains misleading information, repeats banned content, or otherwise violates these terms.
You may close your account at any time from your profile settings. Self-suspending your account hides your profile and posts from the public while keeping your data; deleting your account is permanent and irreversible (subject to retention obligations described in the Privacy Policy).
4. User conduct
You agree to use Siterka in good faith and in compliance with all applicable laws. You will not post content that is fraudulent, deceptive, defamatory, obscene, threatening, hateful, discriminatory, or that infringes any third party's intellectual property or privacy rights. You will not upload photographs of minors without the written consent of their parent or legal guardian, and you will not misrepresent your identity, qualifications, or availability.
You will not use the platform to circumvent verification or moderation systems, send unsolicited bulk messages, scrape listings programmatically, or attempt to extract personal data of other users beyond what they have voluntarily made public. You will not attempt to coordinate off-platform payment, contact, or transactions specifically to avoid Siterka's safety, dispute, or messaging mediation features before the parties have agreed to engage.
You will not interfere with the operation of the platform — including, without limitation, by uploading malware, attempting to gain unauthorized access, probing for vulnerabilities outside a coordinated disclosure process, or sending automated traffic. You agree to report any safety concern, suspected fraud, or guideline violation through the contact channels described in the Community Guidelines.
5. Marketplace role
Siterka is a directory and communication platform. We are not a party to any agreement reached between caregivers and parents. We do not employ caregivers, supply staff, or act as a placement agency. We do not perform background checks, verify professional qualifications, or supervise the actual work performed. Any decision to engage a caregiver is solely between the parent and the caregiver.
You are responsible for assessing whether a person you contact through Siterka is suitable for your situation, including by checking references, qualifications, identity documents, and any required permits or insurance. We strongly encourage in-person meetings before any care arrangement begins. The platform may surface trust signals (verified email, presence dot, response indicators) but these are aids, not guarantees.
6. Subscriptions and the launch promo
During the launch promotional period, all features are free for both parents and caregivers. Once paid subscriptions go live we will introduce one or more tiers. Subscription terms, prices, billing cycles, and renewal behavior will be displayed clearly on the pricing page before any charge is taken, and you will be required to actively confirm any subscription before payment is captured.
Once a subscription is active you authorize Siterka or its payment processor to charge the chosen payment method on the agreed cycle. We may change pricing or feature availability with at least thirty (30) days' notice; changes do not affect already-paid periods. Promotional codes, free trials, and similar offers are limited to one per account unless explicitly stated otherwise.
7. Refunds
Subscription fees are generally non-refundable except where required by mandatory consumer-protection law (in Serbia, the Law on Consumer Protection). Where you are entitled to withdraw from a distance contract within the legally mandated cooling-off period, you may do so by contacting us at the address below. We may offer pro-rata refunds at our discretion in cases of demonstrable platform malfunction.
8. Intellectual property
The Siterka name, wordmark, logos, page layouts, source code, and overall look-and-feel are owned by us and protected under Serbian and international intellectual property law. You may not copy, modify, distribute, sell, or use them without our prior written permission, except as strictly necessary to use the platform as intended.
You retain ownership of the Content you submit. By submitting Content you grant Siterka a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and adapt that Content for the purpose of operating, promoting, and improving the platform. The licence ends when you delete the Content, except for back-up copies retained for the periods set out in the Privacy Policy.
9. Limitation of liability
To the fullest extent permitted by law, Siterka is provided "as is" without warranty of any kind. We do not guarantee that the platform will be uninterrupted, error-free, or that any specific match between a parent and a caregiver will be successful. We do not endorse any user, listing, profile, or message, and we are not liable for the conduct of any user on or off the platform.
We will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of data, profits, goodwill, or business opportunity, arising out of or related to your use of the platform. Where liability cannot be excluded by mandatory law, our aggregate liability to you for all claims in any twelve-month period is capped at the greater of (a) the amount you paid us in subscription fees during that period, or (b) one hundred euros (EUR 100).
10. Indemnification
You agree to indemnify and hold harmless Siterka, its team, contractors, and partners against any claims, damages, costs, or expenses (including reasonable legal fees) arising from your breach of these terms, your Content, or any care arrangement you enter into through the platform.
11. Termination
You may close your account at any time. We may suspend or terminate your access immediately, with or without notice, if we reasonably believe you have breached these terms, posed a safety risk to other users, engaged in fraudulent conduct, or repeatedly attempted to circumvent platform rules.
On termination your listings will be removed from public view. Outstanding messages may be retained for the periods described in the Privacy Policy. Sections of these terms which by their nature should survive termination — including limitation of liability, indemnification, and governing law — will continue to apply.
12. Governing law and jurisdiction
These terms are governed by the laws of the Republic of Serbia, without regard to conflict-of-law principles. Where you are a consumer, this choice does not deprive you of the protection afforded by mandatory provisions of the law of your country of residence.
Any dispute that cannot be resolved through good-faith negotiation will be submitted to the exclusive jurisdiction of the competent courts in Belgrade, Serbia, except where mandatory consumer-protection law gives you the right to bring proceedings in the courts of your country of residence.
13. Changes to these terms
We may update these terms from time to time. The current version, with the date of last update, will always be available at /terms. For material changes that affect your rights or obligations we will give you reasonable advance notice through email or an in-product banner. Continued use of the platform after the effective date of the changes constitutes acceptance.
